THIS VACATION RENTAL AGREEMENT (the “Agreement”) is entered into this by and between CKC Properties, LLC, (the “Manager”) and {{guest_name}} (the `Guest`).
Guest Information:
1. Term. Term beginning on the Arrival Date {{checkin_date}} and ending on the Departure Date {{checkout_date}}. Check-in is 4:00 p.m. and Check-out is 11:00 a.m. Certain properties are available for early check-in and/or late check-out for an additional fee.
2. Property & Address. The vacation rental property {{listing_name}} (the “Property”) is located at: {{address}}
3. Occupancy Limit. The maximum number of guests allowed at the Property at any one time is: 6 (Occupancy limits are subject change based on city ordinance revisions).
4. Rental Amount, Fees and Payments. It is hereby agreed that the TOTAL RENT DUE is stated in listing website. Rent and Fees for the Property are due as follows: {{price_break_down}}
*In the event that the Guest reserves accommodations through a booking platform other than CharlestonVacays.com, the payment schedule and cancelation policy listed on the booking platform shall supersede the payment and cancelation terms listed in this agreement.
A.) INITIAL RESERVATION PAYMENT – 50% payment of the total rent is due immediately at time of booking. Guests must cancel a minimum of 14 days prior to check-in date to receive a full refund, minus the $49 Damage Protection Wavier.
B.) FINAL PAYMENT OF RENT – b.) FINAL PAYMENT OF RENT – Final 50% payment of the total rent is due 14 days prior to the check in date on {{checkin_date}}. This amount will automatically process to the card on-file, after this date there are no refunds of any amount of the booking payments.
C.) DAMAGE WAIVER- As a part of the Guest Booking, Guests have been charged a Non-Refundable Damage Protection Waiver Fee of $49 designated to cover booking fees (Processing and Platform fees) in the event of cancelation and/or unintentional damages to the rental unit that occur during a Guests stay, provided they are disclosed to the Manager prior to check-out. This policy will cover a maximum benefit of $500 for damages. Any damages that exceed the $500 during the Guest’s stay or are not covered by the policy, will be charged to the credit card on file upon the Manager’s determination of the cost of the damage related repairs. Certain terms and conditions apply as listed in section 7 of the Rental Agreement. This fee is non-refundable upon booking and will not be refunded if the reservation is canceled at any time, including within the cancelation period.
d.) Manager’s may unilaterally terminate the reservation if the Signed Rental Agreement and Final Payment has not been received upon Final Payment is due date.
5. Travel insurance. You are not required to obtain Travel Insurance that provides protection for cancellations, but we recommend that you do. Please note that no refunds will be provided by Manager due to any situation arising within Fourteen (14) days from arrival date on {{checkin_date}} unless certain situations arise as listed in Section 9 herein. If you wish to receive a list of Travel Insurance companies to protect your stay against cancellations, we are happy to provide it.
6. Parking Limit for Rental. There are 2 stacked on-site parking spaces included with this house.
7. Handicapped Accessibility Property Damage or Injury. Guest and Guest’s Party agree that property is not a handicapped accessible property. Guest agrees to indemnify and hold harmless Manager and the owner of the Property against all loss, damage, expense, and penalty arising from any action of the Guest or Guest’s Party which causes injury or death to any person or damage to Property or the surroundings properties.
7A. A $49 Damage Waiver fee below was automatically calculated at the time of booking and was included in the total as well as itemized under `Damage Waiver` in the subtotal. The Damage Waiver covers up to $500 of unavoidable damage to the Property or its contents (such as furniture, fixtures, and appliances) only if the Guest reports the incident to the Manager before checking out and misuse and negligence was not the cause of the issue. Spilling, soiled linens/mattresses and stains are not covered by this policy. The Damage Waiver eliminates the need for a traditional security deposit. The Damage Waiver ONLY covers damage during the Term of this Agreement and only provides coverage for the Guests and the Guest’s Party for any damages reported before checking out. The Damage Waiver program is provided and administered by Manager and is not an insurance policy. The Damage Waiver does not provide liability coverage or cover vehicles or Guest’s personal items. Damage waiver solely protects Guests from incurring expenses related to unavoidable damage to their vacation rental property during their stay. It does NOT cover damages caused through negligence or misuse.
Coverage is not provided for loss due to: a. inclement weather or natural disaster; b. Guests intentional acts or gross negligence; these include but are not limited to damage caused by smoking See smoking policy Section 17), pets (See pet policy Section 16), Party related damages, small children left unattended, theft, or any inventory removal in the rental. c. normal wear and tear of the real or personal property assigned to the Property; d. any damage that occurs if Guest is in violation of the Vacation Rental Agreement; e. loss, theft or damage to any personal effects owned by Guest and/or Guests Party which has been brought on the covered Trip by Guest or Guests Party; f. loss, theft or damage caused by any person other than Guest or Guests Party with whom Guest share the Accommodation reservation. g. The Damage Waiver does not cover damage to any structure other than the Property covered by Guest’s confirmed reservation. h. Damages exceeding $500 in replacement or repair cost per stay. Any costs beyond the $500 will be charged to Guest credit card on file.
Guest Duties in the Event of a Loss: Guest must: 1. take all reasonable, necessary steps to protect the property and prevent further damage to it; 2. report the loss in writing prior to check-out to the Manager; 3. provide the Manager with all documentation such as the rental agreement, police report and damage estimate. 4. The Damage Waiver does not cover damage to any structure other than the Property covered by Guest confirmed reservation
The Manager of the Property and the Agent of the property owner and is acting at all times in the best interest of the owner. Guest(s) agree to indemnify and hold harmless the property owner and Manager, their employees and their representatives from claims, suits or damages of any kind including personal injury arising out of or related to: (a) any acts or omissions of Guest(s) or their guests or invitees, (b) Guest`s occupancy of the property including damages or losses arising from the Manager, their employees` and their representatives` negligence or gross negligence, (c) theft of, or damage to the personal property of the Guest(s) or their guests or invitees, personal property, (d) any damages or losses relating to fire, acts of God, criminal acts, acts of the Owner`s or Manager’s negligence or gross negligence or failure thereof, or (e) the presence mold or hazardous materials. Under no circumstances shall Guest(s) be entitled to recover consequential, incidental, or punitive damages from the Owner, Manager, and Manager’s employees or representatives. Guest is encouraged to secure the appropriate travelers or vacation insurance and/or renters insurance.
