In consideration of the monies received and the mutual promises contained herein, we, Travis Smith and Shawn Buchanan DBA
Smith & Buchanan, LLC, the owners (“Owner”) of 216 Village Point Drive, Breckenridge, Colorado (“Property”), give a license to use
the Property to the undersigned, (“Guest”), on the property and dates described on the Reservation Confirmation and above, under
the conditions stated herein. The term “guest” includes Guest and his/her invitees. Owner’s Agent refers to Owner or any person or
entity appointed by Owner to serve in that capacity.
Occupancy Terms: The dates, payment and payment terms of this occupancy agreement will be as is stated above or have been
provided by owner in a separate rental confirmation sent by email from Owner or Owners Agent. Changes must be in writing; such
writing may be an e-mail.
Payment Policies: All payments are due at time of booking. 1⁄2 due at booking and 1⁄2 due 30 days prior to check in for
reservations less than 21 days. 1⁄2 due at booking and 1⁄2 due 60 days prior to check in for reservations more than 21 days.
Reservations made through online booking sites are subject to the online booking site payment policy.
Cancellation Policy: Reservations made through online booking sites are subject to the cancellation policies of the online platform
in which the reservation was made (VRBO, Airbnb, etc.). All refunds will be subject to booking fees incurred by Owner from VRBO,
Airbnb, etc., regardless of when cancellation is made.
For reservations less than 21 days made directly through owner: A full refund will be given to cancellations made more than 30
days prior to arrival, 50% refund for cancellations made more than 14 days of arrival, and No refunds made 14 days or less of
arrival.
For reservations more than 21 days made directly through owner: A full refund will be given to cancellations made more than 90
days prior to arrival, 75% refund for cancellations made more than 60 days of arrival, 50% refund for cancellations made more
than 30 days of arrival, and No refunds made 30 days or less of arrival. At owners discretion, in the event the owner is able to rent
some of the canceled dates to another guest, the owner may refund the value of the rebooked nights to theguest.
Security Deposit: Guest agrees to be responsible for the care and security of the Property during the stay. Guest will be asked to
provide Owner with payment for damage insurance at the current rate or a separate payment of $250 to serve as a security deposit
to remain with Owner until an inspection of the unit is completed following the Guests’ departure. Guest also agrees to pay Owner
the amount of actual damages to the Property, any personal property of Owner located on the Property, and any damage to
property damaged by Guest or their invitees within the Village Point Townhomes At Breck above and beyond the insurance
coverage or the $250 arising from any such damage , as well as for missing items, excessive clean-up, removal of pet or smoke
odors, any other costs incurred by Owner due to Guests’ stay and, if necessary, the cost incurred in removing Guest from the
Property. If the unit has been inspected and no costs are assessed the security deposit will be refunded according to the policies of
the booking site used (VRBO, Airbnb, etc.). Security deposits for all other bookings will be refunded within 14days.
Entry/Check In: Guest will be issued an entry code for the door. Guests may not change the code. Guests should contact Owner’s
Agent if there is a problem with entry. Check in time will be any time after 4PM on the scheduled day of arrival. An earlier check in
time is only possible with Owner or Owner’s Agent’s permission. Location and instructions for entry will be provided through
Owner’s Agent prior to arrival.
Check out: Guests must check out of unit by 10AM on scheduled day of departure. Failure to check out promptly at 10AM or
causing the delay of housekeeping to prepare the unit for the next guest may result in an additional fee up to maximum amount of
one night’s rent.
Notification: It is Guest`s sole responsibility to inspect the Property upon arrival. Guest agrees to inspect the entire Property to
ensure that it is free of hazards and properly equipped. Guest assumes the entire risk of injuries arising from use of the Property.
Guests will take reasonable measures to prevent slips in the bathroom, on staircases, on balconies and throughout the Property.
Guest shall contact Owner or Owner’s Agent at the number to be provided if anything is unsatisfactory within 24 hours of arrival.
Guests should exercise additional caution during winter or other times when snow and ice may be present.
Linens, Supplies and Maid Service: Your unit will be cleaned and prepared with fresh bed and bath linens prior to your arrival.
There is NO daily maid service or linen freshening. An initial supply of paper products, soaps, shampoo and trash bags will be
provided. Once the initial supply is used it will be the Guest’s responsibility to replenish the supplies if they so desire.
Smoke Detectors: Guests are reminded to check all smoke detectors upon check in. Smoke and carbon monoxide detectors were
checked prior to your arrival. It is the Guest’s responsibility to contact Owner or Owner’s Agent if there are any concerns or
questions about the working order of the detectors.
Restrictions on Property Use: Guests are prohibited from engaging in any unlawful activity or any other activity that constitutes
a nuisance. Violation of this provision will result in immediate eviction without refund, and Guest will be held liable for any damages
to the Property, contents and grounds.
Parking: There is parking for 1 vehicle in the garage and 1 vehicle directly in front of the garage. Guest is responsible for ensuring
that vehicle does not block thru traffic. Guest must have vehicles removed before checkout time so as not to block future Guests.
Windows and Doors: Guests must keep windows and doors closed during the winter months. Failure to do so may result in a
charge to Guest for any damage caused by open windows or doors.
Fireplace: The fireplace is gas only. Do not throw any paper or any other combustible materials into the fireplace.
Plumbing: Do not flush anything other than toilet paper in the toilets. No feminine products should be flushed.
