1. THE AGREEMENT
This is a temporary, revocable license to occupy 11616 S. Norstead Lane, Cedar, MI 49621 (the “Premises”) for short-term lodging only. It is not a lease, tenancy, or conveyance of any interest in real property. This Agreement creates no landlord-tenant relationship or right of continued occupancy, and Licensee's right to occupy ends automatically when the Term expires.
Term: begins [Arrival Date] and ends [Departure Date]. Check-in [TIME]; check-out [TIME]. Early check-in or late check-out requires prior written approval and may incur additional charges.
2. PAYMENT & DEPOSIT
License fee: [TBD], due in full in advance. Refunds follow the applicable cancellation policy.
Security deposit: [$0.00] (may be held or authorized on a card) covers damage beyond normal wear, missing items, excess cleaning, lost keys/access devices, or other defaults. Report any pre-existing damage in writing within 24 hours of arrival.
By signing, Licensee authorizes Licensor to charge the card on file for the license fee, cleaning/pet fees, damages, theft, unauthorized guests or pets, fines, holdover charges, and any other amount owed, including charges discovered after checkout. An itemized statement is available on request.
Payment disputes must be raised directly with Licensor. Initiating a chargeback instead (other than for fraud or billing error) is a breach of this Agreement, and Licensor may share this Agreement and stay records with the payment processor to contest it.
3. HOUSE RULES
Occupancy: max 10 guests (age 2+ counted) unless approved in writing.
Quiet hours 10:00 PM to 8:00 AM. No parties, events, commercial activity, or photo shoots without written permission.
Trash goes in the dumpster only, never left outside, on porches, decks, or in vehicles (wildlife will get into it).
Smoking is outside only, 20+ feet from the building. Evidence of indoor smoking results in an added cleaning charge.
Fireworks, sparklers, and pyrotechnics are prohibited at all times. Violations are grounds for immediate termination with no refund.
Cooking only in designated areas/grills; fully extinguish fires before leaving them unattended.
Furniture should stay as arranged; please don't rearrange it.
Pets require prior written approval and a pet fee; service animals are welcome per law, and the handler is responsible for their care, supervision, and any damage.
Firearms/weapons require Licensor's prior written consent, where permitted by law.
No flammable, explosive, or otherwise dangerous materials beyond ordinary household use.
Leave the Premises in the condition it was received, ordinary wear and tear excepted.
4. IDENTITY, ACCESS & CANCELLATION
Information Licensee provides must be true and accurate; Licensor may request photo ID matching the payment method. Licensor may refuse or cancel a reservation that violates this Agreement, house rules, or poses a risk to the property, neighbors, or guests, refunded per the cancellation policy. Exterior-only security cameras and noise/smoking sensors may be present (no audio or interior video); do not tamper with them. Licensor may enter for inspections or repairs with Licensee's consent (not unreasonably withheld), or without consent in an emergency.
If Licensor cancels before the stay, Licensee is refunded in full. Guest-initiated cancellations follow the applicable cancellation policy. Force majeure events (natural disasters, government orders, and similar events beyond Licensor's control) may require cancellation with a full refund but no further compensation.
5. AMENITIES: USE AT YOUR OWN RISK
The amenities below carry inherent risks of injury; Section 7 (Assumption of Risk & Liability Waiver) applies to all of them.
Hot tub: adults must supervise guests under 14; under age 5 not permitted. Shower first; no glass, food, pets, alcohol, or drugs. Not for pregnant guests or heat-sensitive conditions without medical clearance. Misuse causing contamination or damage: $300 fee.
Decks & balconies: no sitting, climbing, or leaning on railings; no jumping or overloading. Supervise children.
Fire pit: designated pit only, no accelerants, never left unattended, fully extinguish after use. Not for use while impaired or in unsafe weather.
Game room: use equipment as intended, no food or drinks near tables, supervise children. Damage beyond normal wear is billable.
Common areas & trails (horseshoes, bocce, lawn games, ~2 miles of trails): stay on marked trails. Off-trail travel may trespass onto neighboring land, at Licensee's responsibility.
EV charger: use per posted instructions only; no extension cords or household outlets. Misuse damage is billable.
Wi-Fi is a convenience, not guaranteed for work, streaming, or gaming; no refunds for outages.
Well, septic & propane: septic-safe toilet paper only; no wipes, hygiene products, grease, or paper towels. Report issues promptly; damage from misuse is billable. Temporary utility interruptions are not a breach of this Agreement.
This is a natural, wooded, snow-belt setting: occasional insects, wildlife, hazardous winter roads, and delayed plowing are normal and not grounds for a refund.
Licensee is solely responsible for supervising children around water, stairs, decks, fire, and all other amenities.
6. IF SOMETHING GOES WRONG
Damages & theft: Licensee is responsible for damage or theft during the stay, by Licensee or guests, including if the Premises becomes unrentable, chargeable at the advertised nightly rate until restored, plus repair costs. Licensor is not responsible for loss of Licensee's personal property.
Holdover: unauthorized occupancy past checkout may incur $200/hour, access shutoff, and removal or towing of belongings at Licensee's expense.
Cause for removal: violating this Agreement (occupancy limits, pets, smoking, fireworks, parties, noise, parking, etc.) may result in immediate removal with forfeiture of all amounts paid.
Licensee must comply with all applicable laws, ordinances, and regulations during the stay.
7. ASSUMPTION OF RISK & LIABILITY WAIVER
Use of the Premises and all amenities (hot tub, decks, fire pit, game room, trails, EV charger, and similar features) carries inherent risks of injury, illness, property damage, or death, including slips and falls, water and fire hazards, wildlife, and equipment misuse. Licensee voluntarily assumes these risks for themselves and everyone in their group, including minors and guests, and is responsible for supervising the group and assessing their fitness to participate; judgment can be impaired by alcohol, medication, or health conditions. To the fullest extent permitted by law, Licensee releases Norstead, LLC and its owners, agents, employees, contractors, and property managers from claims arising from Licensee's or the group's use of the Premises, except for Licensor's gross negligence or willful misconduct, and agrees to indemnify and hold them harmless for the same.
8. LEGAL TERMS
This Agreement is governed by the laws of the state where the Premises is located. Disputes are resolved first by negotiation, then mediation, then binding arbitration under American Arbitration Association rules in the county where the Premises is located. By signing, Licensee waives the right to a jury trial and to bring or join a class, collective, or representative action; small-claims court remains available for qualifying claims. If Licensor must retain an attorney to enforce this Agreement or collect amounts owed, Licensee is responsible for reasonable attorney's fees and costs.
