LIABILITY WAIVER AND RELEASE AGREEMENT
WAIVER OF CLAIMS AND INDEMNIFICATION

Tenant hereby acknowledges and agrees that Tenant’s use of the Landlord’s property and the use of any permitted equipment and amenities, including but not limited to the hot tub, beach toys, beach chairs, grill, basketball hoop, fire pit, appliances, bicycles, and electric bicycles, involves inherent risks of injury to persons and property, and Tenant voluntarily assumes full responsibility for such risks.

In consideration of being permitted to lease the property and use permitted equipment and amenities for any purpose, Tenant hereby releases and holds harmless the Landlord, its members, officers, employees, and agents from all liability to Tenant and Tenant’s invitees, personal representatives, assigns, heirs, and next of kin for any loss, damage, or injury, including death, arising out of or related to Tenant’s occupancy of the property or use of permitted equipment and amenities, whether caused by the active or passive negligence of Landlord or otherwise, to the fullest extent permitted by the laws of the Commonwealth of Massachusetts.

Tenant further agrees to indemnify and hold Landlord harmless from any loss, liability, damage, or cost Landlord may incur arising from Tenant’s presence on the property or use of permitted equipment or amenities, whether caused by the negligence of Tenant or otherwise.

Tenant expressly agrees that this release, waiver, and indemnification provision is intended to be as broad and inclusive as permitted by Massachusetts law and that if any portion is held invalid, the remaining portions shall continue in full force and effect. Tenant acknowledges that no oral representations, statements, or inducements apart from this written agreement have been made.
